Samenvatting

    South Africa underwent an unprecedented transition in 1994. The country changed from the Apartheid regime into a system founded on the principles of the rule of law and equal treatment for all. Along with this political regime change, a wide range of social rights were included in the Constitution, which grants al citizens a constitutional right to a wide range of social services. Moreover, the system of governance and organisation of services was designed according to the latest insights from the then emerging new public management paradigm. Now, twenty years later, the system is crumbling; many of the basic services are not properly provided to citizens. Partly, this is a consequence of a basic absence of integrity in parts of the political class and in elements of the civil service. However, as we illustrate in a case analysis of the Water Boards in the Western Cape Province, the problem is also a consequence of the design of the system of governance. The combination of unlimited constitutional access to services and a stringent regime of new public management principles in the organisation of service provision has led to a serious crisis of performance. Therefore, the solution for the problem may be to redesign the system according to other governance principles, such as learning governance and networked governance.

Samenvatting

    In Dutch semi-public sectors of education, healthcare, and housing there is a tendency towards governance based inspection. The attention of inspectorates shifts from inspection on minimum quality standards to inspection on governance based quality improvement. The aim of this special issue is to learn more about the opportunities and risks of governance based inspection. The survey and sector articles show that governance based inspection (1) puts the responsibility of governors to stimulate quality on the agenda, (2) makes governors more aware of the quality targets they want to achieve within their organisations, and (3) has a deregulating effect. However, the risks are (1) reregulation via sector norms, (2) a lack of reality checks, and (3) a narrow focus on governors instead of the quality of public services. Consequently, inspectors have to learn new skills and competences. All in all, governance based inspection can complement but not replace other ways of inspection.

    In this contribution we introduce the principles of proper administration and the principles of good administration as public values and the definitions of these terms including the concept of good governance. Two main developments in relation to these principles are described here. The first line is from unwritten principles (developed by the judiciary) to written principles of proper administration by which there is in addition to the classical legal protection function, the instrumental function of these principles that has become more important. The second line is from the starting point of the principles of good administration - which can be found more in the legislation and the (policy)regulation but in a fragmentary way - to the application. This application is checked by the National Ombudsman, the Court of Audit and - more recent - also the European judiciary are working with these principles. For guaranteeing the public values there is - from the concept of good governance - now a need for integration of these principles of good administration in the Netherlands General Administrative Law Act and in the case law of the Netherlands judiciary.

    In this literature review we present and discuss the key concepts of this symposium issue: (good) governance, (public) values, and the management of tensions between public values. The article concludes with an overview of strategies on how to deal with public values as a prelude to the remainder of the symposium, and discusses the implications of the distinguished strategies for public administration practice.
