In the near future, the Dutch government intends to change the rules relating to smoking bans in the hospitality industry again. After a complete ban, coming into force in July 2008, and introducing an exception for small bars in June 2011, the complete ban will return this year. This article describes the law regarding smoking bans in the Netherlands, and reports along researches of the relevant authority and a commercial research institute the effectiveness of the bans. From these findings it becomes clear that the hospitality industry did a good job in complying with the bans. But there is one exception: small bars. Next we explain, based on the ideas of Kagan and Skolnick and Elias the effectiveness of smoking bans. |

The article provides a theoretical and empirical analysis of the Night Time Economy and how the Collective Pub Ban is applied in three Dutch cities: Utrecht, Amersfoort and Den Bosch. The Collective Pub Ban is a measure taken in the Netherlands in an effort to make pubs, bars and clubs co-responsible for maintaining security. Depending on the severity of the conduct, an offender can be denied of entry to these venues for five years. During this period, the offender is not allowed to enter the particular pub or any of the other pubs, bars and clubs that participate in this measure. On the basis of 84 interviews, we show how these venues fill out their new responsibilities with respect to the Collective Pub Ban-measure. Also, we answer the question what this new measure means for the quality of the public space. |

The factor time is an often neglected issue in the literature on network governance. In this article we analyze the differences in perceptions on time between actors involved in water governance and describe the managerial interventions aimed at synchronizing time horizons, managing the available amount of time and the tempo of the governance process. Two case studies of governance processes in the district of Water Board Delfland are included to provide insight in the question how the factor time influences the governance processes and how aspects of time are managed. The case studies show that different perceptions of time may cause tensions in collaborative relationships, and even cause the end of collaborations. This underscores the importance of time-sensitive governance. |

De facto autonomy, the actual potential of regulatory agencies to go about their daily work, is often conceived to be more important to explain regulatory capacity than its formal autonomy and responsibilities. In this article we investigate whether external context factors, such as the financial and economic crisis have an impact on de facto autonomy. More specifically, we investigate whether the de facto autonomy varies after the crisis and distinctively so for specific subsets of employees within regulatory agencies. According to literature, mid-level managers of agencies are key to de facto autonomy and building a secure reputation for the agency in question. We test these external and internal effects on de facto autonomy with a survey among employees of the Dutch Financial Market Authority (N = 248). The findings show that the perceived influence of stakeholders is relatively constant, but that it is more dynamic for European stakeholders. Both middle managers and employees working at strategic and policy departments of the agency conceive the impact of European stakeholders as increasing in nature. The findings have important implications for our studies of de facto autonomy of regulatory agencies as well as reform potential after major institutional crises. |

In managing new cleavages between conflicting values (such as materialism and post-materialism), we cannot simply fall back on a classical approach to cleavage management. The segments surrounding the new cleavage are clearly more fluid than those surrounding the religious or socio-economic cleavages from consociationalism and neo-corporatism, such as is rightly emphasised in the network approach. In the conflict between the materialist and post-materialist value pattern, representation logic is not a given certainty. Not only the facts, but also the negotiating players and the decision-making arenas are the subject of negotiation and strategic action. This is reflected in the new forms of consultation politics. Similarly, consensus formation cannot make do with the (party) political integration of the segments because, given the conditions of post-materialism, this integration can only be partial. It seems important in the new cleavage management to devote attention to the existence of several arenas in which political interests are weighed up. For the players involved in a particular policy issue, this means the lure of strategic forum shopping and thus complication of the conflict-resolving ability of each of the forums. |

There are many different ways in which employees may choose to address unequal treatment at work. They may do so themselves, in an informal or formal manner on the work floor. They may also, at some stage in the dispute, decide to involve specialized advisers such as legal advisers, anti-discrimination officers, health and safety executives and labour unions. It is generally assumed that consulting such specialized advisers will help the employee to address unequal treatment more successfully. In this paper, the effectiveness of the interorganizational field of specialized advisers is analyzed on the basis of an elaborate study among different types of respondents. The main finding is that fear of retaliation plays a crucial role in seeking and receiving specialized advice and that the existing interorganizational field broadly fails to cope with this fear. To resolve this issue, the field needs an improved governance structure with better co-ordination between different types of advisers. |

In recent years the Netherlands have seen an upsurge of housing enclaves. The enclaves are often built as courtyards, castles, estates or apartment complexes. The growing number of people living in housing enclaves indicates a demand for this kind of living areas. However, the motivations behind the increasing popularity of housing enclaves are unclear. Is this a reflection of a long standing tradition of people staying in their own social group, seeking for belonging and sociability? Or does it fit in a global trend of searching for security in gated communities? This paper presents empirical research in the Netherlands that addresses peoples’ motives for living in housing enclaves, as well as the role of the local government in relation to housing enclaves. The research shows that residents of housing enclaves seek a pleasant living environment in the first place, while security is a less important motive. The study gives reason for planners and developers outside the US not to assume that fear of crime and a wish for security are the main reasons for moving to housing enclaves. Further, the study shows that housing enclaves are not completely privatized areas. Local government still has an important role to play. |

Fraud seems to be on the rise. That feeds a demand for controls. This paper sketches the diversity of supply in reaction to this demand: public regulators of course, but also commercial information providers and benchmarkers, self-regulating associations, hallmark producers, certification and accreditation bodies, and internal business management control systems, whereby ever more levels of control are piled on top of each other. More than a million Dutchmen earn a living in this booming control-industry, or 14% of the working population. In addition to fraud, other causes of this trend are being discussed, among them, paradoxically, neo-liberalist deregulation policies. All these causes contribute to a sense of risk and uncertainty. Although this trend has a number of negative consequences, it has a major benefit: jobs! Economists may have long thought that transaction costs are there for the transactions. But it looks as if transactions exist to produce transaction costs. |

In the near future a growing number of Dutch regions and municipalities will experience a decline in population and household numbers. However, compared with other countries, the impending population shrinkage in the Netherlands will be modest, if not insignificant. The spatial consequences of this demographic decline will be limited. Other factors, such as economic growth, behavioural change and spatial planning policy, will have a more important influence on spatial development. The fixation on population numbers in both the public debate about demographic decline and in policy-making is therefore misplaced and futile. Insofar as demographic trends already have an influence on spatial developments, it is primarily through changes in household numbers and population composition, for example in relation to housing needs. This does not mean that demographic decline will not raise issues pertinent to spatial development policy. In municipalities and regions, falling household numbers may push up housing vacancy rates and exacerbate segregation, leading to a reduction in the quality of the living environment. These negative consequences will be concentrated in specific districts, neighbourhoods and villages. Demographic decline is not only a threat; it also presents opportunities. In regions currently suffering from serious housing shortages, a shrinking number of households will relieve pressure on the housing market. In addition, contraction of local and regional populations will open up opportunities for reducing densities and 'greening' these neighbourhoods. When anticipating or responding to demographic decline, local and regional governments mainly adopt a strategy of improving the quality of the housing stock and stimulating employment. In both cases, there is a danger of competition between local authorities (or regions and provinces), which may lead to uneconomic spatial investments and irreversible spatial developments. |

Climate change forces to a fundamental reconsideration of our strategic policy, and especially of the relationship between policy and law. With regard to political urgent topics, a tendency towards policy instrumentalism always lies in wait. In the current policy practice this problem manifests itself in the application of law (in many detailed norm prescriptions) and – curiously – also in its policy counterpart: the search towards informal but even goal specific policy processes. The authors plead for dealing with spatial climate challenges by creating room for a strategic policy perspective and a sustainable approach of the relation between law and policy. A qualitative approach of policy and law necessitates an innovative juridical transformation: the use of general normative rules which give direction to flexible policy processes in multiple, specific policy situations. |

Horizontal governance arrangements potentially conflict with the very principles of representative democracy and, likewise, with the existing political institutions. This conflict manifests itself in the interaction between representatives and the executive power: although the former have the formal power, the latter participates in horizontal networks and therefore has the resources that are necessary to form good policy. This erodes the power position of representatives. Frame work setting is commonly suggested as an arrangement for representatives to enhance their grip on policy processes in network-settings. The authors of this contribution examine the effects of frame setting as coupling mechanism between horizontal networks and vertical politics in six policy processes in a Dutch Province. Based on both theory and research findings they redefine the concept of framework setting in order to make it more attuned to the complex, interdependent and dynamic nature of policy-making in networks. |

In the Netherlands, new horizontal forms of accountability have in recent years been introduced for executive agencies. These forms of accountability address other stakeholders besides the hierarchical principal. It includes for example demonstrating responsiveness to clients, independent overseers or professional standards. In this article, two related questions are answered. At first the question is posed whether horizontal accountability can be regarded as a substitute for democratic accountability or as complementary to it. The second question is how their introduction fits with traditional (vertical) forms of accountability. The article is based on a qualitative research that was carried out in 2005 and 2006 on nine large Dutch executive agencies. It focuses on two types of horizontal accountability: accountability of agencies to boards and to an independent evaluation committee ('visitation'). The article concludes that horizontal accountability is best regarded as complementary to democratic accountability. Horizontal accountability has added value because it invokes learning processes. In addition, the introduction of horizontal forms of accountability creates a redundant accountability regime for executive agencies in which they account for the same actions to different accountees. Redundancy has the advantages that it mitigates information asymmetry and incorporates the different expectations for agencies. |
