    Evaluations of EU legislation can fulfill a key role in the European policy process. They can provide the knowledge base required for political accountability towards the electorate, and form a basis for the improvement of existing legislation. This article introduces a research agenda in the realm of the ex-post evaluation of EU legislation, which comprises two research lines. The first strand comprises research into ex post legislative evaluations conducted by the European Commission. This research is innovative, because EU policy researchers so far have barely touched upon evaluation, as a final and important stage in the EU policy cycle. By assessing evaluation critically, we can ascertain to what extent the EU’s ex-post evaluation system is more than an instrument, aimed at increasing the EU’s legitimacy. The second research strand is own evaluation research, focusing on the role of European administrative networks- intergovernmental structures that have been established to improve the implementation of EU legislation by the member states. By critically evaluating the functioning and effectiveness of these networks, I hope to be able to find out whether and under what conditions these network structures are more, than the sum of their national parts.

    Public Administration as a scientific discipline can increase its scientific and social relevance if it takes a more design-oriented approach. With that I go back to the classical notion of Herbert Simon that public administration is a design science. I advocate revitalizing that idea. This is necessary if we look at the problems governments are struggling with, but also in view of the developments in the environment of our field. But it is also promising because it offers opportunities to achieve innovative, scientific knowledge. The design sciences contain numerous insights into how a public administration design process can be set up, with room for creativity, abduction and intuition. I divide a public design process into five rounds: the round of understanding the issue, defining or demarcating it, coming up with possible solutions, testing and refining these solutions and distilling the more generically applicable elements. This is ideally done through fast, iterative rounds of developing, testing and refining designs. In such a design process, disciplinary knowledge can play an important role in understanding the issue and coming up with possible designs. And so designing can also become a way to validate this knowledge.

    Changing behavior is often necessary to tackle societal problems. Governments can change behavior via economic incentives (such as subsidies for electric cars), bans/mandates (such as prison sentences for drug smuggling), communication (for example information campaigns) and nudges (for example, being a donor by default). However, the government should not be a manipulator that applies the latest behavioral tricks without societal support. Public administration research shows that support cannot be taken for granted. If there is no support for behavioral change, well-intended interventions can even be counterproductive. I therefore develop a model for supported behavioral change. I provide five criteria that indicate when there is supported behavioral change: if the behavioral change is both effective (1) and efficient (2), and when there is support for behavioral change among politicians (3), among implementing organizations (4), and among citizens (5).

    In this article in the series on the local democratic audit, the authors argue that municipal democracy in the Netherlands has become a multiple democracy. Within the formal framework of representative democracy, numerous democratic arrangements have emerged that may be referred to as participatory, direct and also what the authors call ‘do-democracy’. Additions to representative democracy did not come without reason: representative democracy is not a perfect system, either in theory or in practice. Efforts have been made to improve the functioning of representative democracy in a number of ways. Three of these are discussed in this article. The authors note that these three reforms do not solve the problems in representative democracy. So the Dutch municipalities have started looking for additions to representative democracy. In this article various forms of participatory, do-it-yourself and direct democracy are discussed. Many effects of these reforms are still unknown and knowledge about them has crumbled, but one conclusion can be drawn: people with a low education are not inclined to take part, even with arrangements that are easily accessible. Striving for a more vital local democracy seems meaningful; the authors formulate a number of ways of thinking about this.

    Singapore and the Netherlands are small, export- and trade-dependent countries that perform excellently in many areas, such as good governance and integrity, policy effectiveness, liveability, innovation, and e-government. At the same time there are clear differences in political culture and history: Singapore has a more authoritarian governance style including limitations in press freedom, freedom of speech, and political activism. Within these contrasting contexts, both countries have introduced and implemented similar public management reforms since the 1990s. The aim of these reforms is to maintain public service excellence in a dynamic environment but the countries make contrasting choices in achieving this aim. This article describes how administrative excellence is organised and pursued in Singapore and identifies five lessons for the Netherlands: (1) Use positive narratives about government often; (2) be nuanced about capping top-level remuneration; (3) enhance the attractiveness of government as an employer; (4) invest in life-long learning; (5) be an authoritative expert amidst horizontalisation hypes.

    The democratic deficit is generally observed to be one of the largest challenges facing the European Union. This is in spite of the fact that the member states introduced transparency in 1992 to address this legitimacy problem. This article asks why, after several decades, the transparency policy has still not delivered on its promise. In doing so, it bases itself on new empirical data that was collected in the context of a recently presented dissertation (Hillebrandt, 2017), while drawing a strict distinction between the empirical policy change question and the normative desirability question. From a longitudinal comparative analysis, a differentiated empirical image arises. On the one hand, a clear enhancement of legislative transparency can be discerned; on the other hand, a plurality of transparency-evasive practices has emerged in the area of non-legislative decision-making. This equivocal image supports contrasting normative responses, according to which transparency is respectively cast as an indispensable ideal, a fiction, or a solution in search of a problem.

    Civil servants at the Dutch authorities increasingly make use of behavioural insights in the policy process. These insights are primarily put on the agenda at the level of the national government in the Netherlands. However, they also seem to be particularly useful at the local level. After all, behaviour-conscious policy focuses on behavioural change through the redesign of the direct environments of citizens, and local authorities have a clear view and control over these environments. In the light of this potential, this article explores the current rise and institutionalization of behavioural expertise in local government. The work practices of local behavioural experts are examined on the basis of three dimensions of local government: positioning, practices and politics. The findings show that local behavioural experts are still in an experimental and start-up phase, but at the same time are already working with a wealth of behavioural assignments. In doing so, they deal tactically with scarce resources, resistance and abrasive institutional logics. The article shows that behavioural insights and designs are also promising in local government, that a local administrative landscape of behavioural expertise is already being developed; and that making meters in the field of behavioural expertise calls for several forms of coordination.

    In Nederland komen tal van wicked problems (WP) voor. Ze worden ook wel aangeduid als weerbarstige problemen. Kenmerkend is het unieke karakter, het feit dat kennis over probleemaspecten beperkt is en verschillende perspectieven op een probleem en meerdere waardenoriëntaties een rol spelen. Naast cognitieve en normatieve complexiteit bestaat er ook nog sociale complexiteit. WPs zoals voetbalvandalisme spelen zich af in een beleidsnetwerk met tal van elkaar afhankelijke actoren. Kennis, preferenties, handelingsvermogen en middelen blijken gespreid en niet in de hand van één actor. Om toch tot een bevredigend resultaat te komen moeten de actoren gezamenlijk optrekken. Daarom is interorganisationeel netwerkmanagement en deliberatie met burgers een wenselijke responsestrategie. Bij WPs zijn actoren dus tot elkaar veroordeeld. Centralistische besluitvorming werkt niet. Een centrale actor kan overigens nog wel een rol vervullen als initiator, facilitator of regisseur van overleg en discussie; als arbiter bij botsende perspectieven; of beslisser na netwerkberaad en inbreng van burgers.

    This paper presents the policy theory of the Dutch Inspectorate of Education’s 2017 framework. The framework includes a set of indicators and working methods for the inspections of school boards which are expected to lead to improved quality and organizational learning of the schools and colleges within each board’s portfolio. Inspection feedback, quality assurance, stakeholder involvement and governance are the key mechanisms through which customized inspections are assumed to affect change. These customized inspections start from a set of legal requirements schools and colleges have to meet, but add inspections modules which are agreed on with each school board at the start of an inspection visit. As these inspections are currently being implemented, there is no evidence yet on the validity of these assumptions.

    In this article, we discuss how regulation of governance in healthcare has been shaped over the past decade. We describe the presuppositions under this movement. Searching and balancing was needed to meet the complexity of care management. This has to do with the fact that the external pressure on the regulator after incidents is high. Due to this pressure, it is necessary to constantly ensure that management-oriented regulation does not narrow to the supervision on the actor with final responsibility. The regulation of good governance requires reflectivity of the inspectors and is aimed at stimulating recoupling between management and shop floors. This requires space for experimentation for both managers and inspectors. To provide this space, we do not only need a political and social debate about the quality of care and its management, but also attention and appreciation for the difficult considerations of organizing care.

    In practice, diversity interventions do not always appear to be effective. One argument is that there is little or no match between the perspectives of public organizations on diversity and the interventions used. This article provides an overview of the underlying rationales for diversity policy and discusses the perspectives on diversity from the diversity literature, HRM, and management literature and how these overlap, complement each other and differ from each other. What these perspectives have in common is that they all emphasize the added value of diversity. In the diversity literature, the emphasis is on the four perspectives equality, legitimacy, creativity, and the labour market. HRM literature focusses on managing differences. In public administration, there is a shift from active representation by individuals to connecting by all employees. Furthermore, the binding perspective is gaining more and more importance in the public domain because it may be possible to close the gap between the government and its citizen. This perspective emphasizes the importance of the long-term relationship with citizens to strengthen the trust of citizens in the government for realizing social tasks and responsibilities. It makes diversity an issue for all employees. For Hassan and Havva, and also for Hans and Hanna.

    Using survey data from 1,300 welfare recipients in the Netherlands, this paper explores the effects of different enforcement styles in the field of social security law. Although most policy debates focus on punitive and persuasive enforcement, our findings suggest that both styles only play a limited role in explaining regulatory compliance. Our study also shows that the level of compliance among welfare recipients is related to their ‘motivational postures’ (Braithwaite 2003; 2009; 2011). While some of these ‘postures’ are shaped by elements of procedural justice, others are related to the perceived legitimacy of laws or to instrumental motives. Given these findings, we suggest that compliance with social security laws may not only depend on punitive or persuasive enforcement, but also on the degree in which regulatory enforcement is attuned to the individual characteristics of welfare recipients. Finally, these ideas are translated into several practical suggestions for the ‘smart enforcement’ of social security law.

Hoe politieagenten omgaan met waardeconflicten die ontstaan door sociale media

    Social media changes society and causes new dilemmas in local government. Little is known about the nature of these conflicts and the way government organizations deal with them. Therefore the authors of this article have carried out empirical research into the manner in which police officers deal with value conflicts concerning the use of social media. Their research shows that the well-known conflicts in the literature between effectiveness and efficiency and between effectiveness and legality were also dominant in this case, but that many more conflicts than are known from other studies concerned transparency and participation. In addition they discovered that the bias strategy was often used, which suggests that a conservative response is preferable in a situation with a lot of dynamics. In this way the research shows how government officials deal with the tension between a stable organization and a dynamic environment and look for appropriate forms of coping at this specific interface. The authors stress in their recommendations that the further strengthening of the learning ability of organizations deserves attention: not just to find the right way to deal with value conflicts, but to be able to find new ways to deal with the new conflicts that arise.

De ongekende effecten van deregulering: een experiment in Hollands Kroon

    What happens in the case of massive deregulation in the local public domain? Despite the widespread call for ‘less regulation’, the effects of large-scale deregulation have received surprisingly little academic attention. In this article, we present the results of a longitudinal study on the effects of deregulation in the Dutch municipality of Hollands Kroon. The municipality abolished a vast number of regulations on public order offences in a radical two-year policy experiment, encouraging citizens to exercise more social control. In contrast, criticasters expected that the experiment would lead to more public offenses and conflict. Based on our data collected over three survey rounds; focus groups with citizens, politicians and civil servants; and several secondary data sources, we conclude that there was little effect: neither an increase in public order offences, nor an increase in social control. Our research shows that, in the short term, deregulation did not significantly affect the behavior of citizens.

    Theory about participation has long moved beyond merely informing citizens, arguing for more influential and effective instruments. Nevertheless, ‘inspraak’ remains widely implemented in Dutch practice, with mixed results. This article argues that the deliberative quality of the instrument is closely related to the performance of power. Dramaturgical concepts are employed to analyze resistance against the siting of a homeless facility in an Amsterdam neighborhood. One particular evening sets the stage for escalation, which ultimately frustrates the policy process. The analysis shows how the performance of the meeting invokes specific kinds of resistance. A different performance of ‘informing’ could potentially improve the quality of the public sphere.

    This text wants to draw attention to the question: How do peer specialists build a bridge between the modus operandi of health care professionals and the lifeworld problems of clients receiving mental health care? The Dutch mental healthcare system has recently been host to a range of new developments. Two new trends can be distinguished, going by the name of ‘Recovery-oriented healthcare’ and the introduction of ‘Peer Specialists’. These coincide with changes in budget and organization of treatment. There is an increased awareness of the need for efficiency and cost reduction in the organization of care. The meaning and use of recovery-centered approaches and working with peer specialists remain fairly marginal enterprises due to ever increasing pressure emanating from execution of regulations and administrative procedures, and an accompanying decrease of professional autonomy. In the light of Habermas’ theoretical framework, it is an emphasis on a system-oriented organization of care that cause new approaches to barely be able to find a considerable place in the contemporary practice of mental healthcare in the Netherlands. Trust is identified as an essential foundation on the basis of which future principles of organization should be developed.

Lokaal bestuur en burgerkracht: slimme sturing in het sociale domein

    The Dutch social care system was fundamentally reformed in 2015. A key policy aim was to activate citizens and their social networks, turning them from mere consumers into co-producers of care. The expectation was that, by doing so, public spending could be reduced and community engagement could be restored at the same time. Regulation was put in place to incentivize network support.
    Whether this constitutes ‘smart governance’, however, depends on whether the variety of factors determining sustainable network support can be identified in the first place. At present, the new care policy is supposed to apply indiscriminately, and is as such not yet evidence based. In addition, flaws in the present budgetary and regulatory steering mechanisms need to be addressed. Potential users are not very familiar with the regulation in place for incentivizing network support, and the regulation is currently neutralized by law courts, unaware of the participatory relationship between care authorities and citizens as envisaged by the 2015 reform. Moreover, engaging networks is time-consuming and requires investments before returns can start to materialize. From a normative stance, network volunteers moreover ought to participate in decision-making, as they will be investing their private resources (such as time) instead of tax payers money. Effectiveness and legitimacy are thus two prerequisites for governance in the social domain to be genuinely ‘smart’.

    This article reports on an analysis of the effectiveness and legitimacy of modes of governance in four European regions that clearly show signs of hybridity, that is, they have private as well as public characteristics. Berlin, Eindhoven, Copenhagen-Malmö and Zurich thus aim to increase the problem-solving capacity of their regional governance and to govern ‘smartly’ in a complex and multi-level context. The individual cities search for effective links with private and societal actors, each in its own way. Legitimacy is an issue that is hardly reflected upon, though. Hybrid modes of governance may have negative impacts on both effectiveness and legitimacy, but also offer new opportunities for good governance. ‘Hybrid’ and ‘smart’ do not always go hand in hand, but they are not mutually exclusive either.

    In 2008 a global economic crisis broke out. Now we can look back at the crisis as a clearly ordered sequence of events. But at the time these events were experienced as unexpected, unordered and unpredictable: a shock situation. How did municipalities respond to this shock situation, to this economic crisis? This article describes how two Dutch municipalities, together with their societal partners, made sense of the economic crisis. This concerns the question of how they interpreted the crisis themselves, but also which actions ensued. From a constructivist position, the article considers how the two municipalities together with their partners made sense of the situation and this enabled them to implement measures that could mitigate the consequences of the crisis for their communities. Based on epistemological and methodological assumptions discourse analysis, the author investigates the role of language in this process of sense-making. This approach offers municipalities insight in the role of stories in policymaking and in determining new practical solutions. The article closes with some guidance on how this perspective can help to people and institutions to cope with comparable situations, specifically in the cooperation between municipalities and other organizations.
