The regulatory agencies in various public service sectors are said to be changing (some) of their regulatory attention issues of internal governance of organizations in education, health care en social housing. This paper aims to assess how (if, at all) responsible actors within those organizations experience this shift in regulatory focus. We report on the findings from a survey with modest N, distributed at an early stage of this new policy. The paper shows that respondents have fairly divergent views on whether or not this regulatory shift has indeed occurred, something which is not uncommon for a new policy. We distinguish three mechanisms through which governance-based oversight may have an impact on public service providers. This new regulatory regime could 1) have an agenda-setting effect within organizations, could 2) stimulate organizational decision-makers to take well-considered decisions and could 3) induce a sense of relational felt accountability towards the regulator. |

The Dutch social housing sector is still recovering from a series of incidents that harmed the sector’s reputation drastically. Part of the recovery plan is the installation of an independent Housing Authority, who focuses specifically upon the ‘governance’ of housing corporations. This article explores the implementation and development of the Authority’s regulation strategy. It finds that although the strategy sharpens the focus of housing corporations and limits risky circumstances and behavior, it also triggers adverse effects. The Authority should therefore adopt a broader outlook, that is more sensitive to (1) the complexity of the social housing task, and (2) the pathologies of multiple accountabilities being placed upon the corporation(sector). |

Deze methode past bij complexe beleidsopgaven, waar meerdere actoren en overheden bij betrokken zijn die een behoefte hebben om te leren van elkaars ervaringen. In de evaluatie van het Natuurpact is deze methode op nationale schaal voor het gedecentraliseerde natuurbeleid toegepast. Uit deze casus blijkt dat een succesvolle toepassing vraagt om een voortdurende en zorgvuldige aansluiting van het onderzoek op de beleidspraktijk. Dit is nodig voor het betrekken van en interactie met stakeholders, het combineren van leren en verantwoorden, de wetenschappelijke onafhankelijkheid, het bestuurlijk mandaat en de beheersbaarheid van het onderzoek. |

Collaboration between public actors and social partners is becoming increasingly important as an administrative solution for complex societal challenges in health care, spatial development, mobility management or water management. In this article we focus on the relationship between the central Flemish government and local networks that are set up by this government. In the scientific literature much attention is paid to the concept of metagovernance as analytical perspective to analyze the relationship between the government and networks. The concept offers the government a toolbox with roles and instruments from which it can choose to support and stimulate networks in order to achieve the desired network results. However, our research shows that such an approach is not sufficient to capture the relationship between the central government and local mandated networks in Flanders. We argue for a broader interpretation of the concept of metagovernance, in which the dynamics of local networks are viewed as the outcome of power relations between actors that are represented at both local and central level and that are intertwined with each other. Only in this way will we we understand why certain choices are made about local mandated networks, why local networks show a lack of dynamism and why local actors in local networks also do not want local networks to become more dynamic and effective. We do notice that the pressure on these arrangements is increasing, partly due to new actors who are not involved in these arrangements. |

Traditional state-centered governance systems have failed to effectively tackle the transnational problem of the sustainability of global value chains (GVCs). To fill this ‘institutional void’, industry and NGOs established a series of global partnerships that designed standards and certification schemes for global commodities. This paper uses different theoretical lenses to address the question as to what extent these arrangements can be evaluated as smart, and for what and for whom they are smart? Despite their relative success, these partnerships face some serious challenges. Consequently, smart governance also requires adaptiveness and the prevention of path dependencies. |

The Dutch Municipal Personal Records Database is an IT-innovation that enables the use of the civil registry by hundreds of (semi-)public organisations. Literature review and a case study show how this ‘basis registration’ creates a deep tension between system and lifeworld: citizens who do not fit the system’s criteria lose their access to the major part of public services. The instrumental rationality of the system simplifies the use of addresses for service delivery to one single definition, turns the consequences of address mutations into a black box, and reduces the discretionary space of street-level bureaucrats to handle with social complexities and unintended consequences of the system. This type of IT-innovations can, therefore, come to resemble a ‘digital cage’: a highly disciplining system that hinges on hardware and software design instead of Weberian rules and procedures. |

This paper analyses various landmark criminal cases in the Netherlands that saw individual professionals being blamed for allegedly contributing to safety-critical events occurring in the past twenty years. These cases can be seen as symbolizing an increasingly risk-averse society whose expectations of human capacity for securing safety have reached unprecedented levels. In this view, punishing professionals who make dangerous mistakes serves to re-establish the illusion of being in control and to satisfy emotions. In practice, however, the prosecution of professional error appears to be somewhat out of touch with public sentiment, as responses to the cases discussed revealed little public support and a backlash among professionals. Moreover, safety science and practice claim that punishing individual error tends to undermine safety and overemphasizes the role of individual error compared to systemic failures. This begs the question of whether criminal liability should be imposed at the system level, as recently happened when local governments were sentenced following fatalities on dangerous road spots. Sentencing ‘system administrators’ may have advantages, but probably produces negative effects as well. Therefore, it would be ideal if administrators reduced the need for resorting to criminal law by proactively and generously taking responsibility for their organisation’s share in accidents. |

The Transatlantic Trade and Investment partnership (TTIP) can be considered a game changer among trade agreements. TTIP not only aims to shape tomorrow’s trade policy, but has also had a huge influence on the democratic legitimacy of the EU. Based on recent literature on democratic legitimacy in the EU, this paper studies how the TTIP negotiations score in terms of input and throughput legitimacy. Our results show that these negotiations have had their fair share of problems, such as the disproportionally large influence of corporations and a lack of transparency and accountability. However, these legitimacy problems occurred mainly in the first months of the negotiation process. Due to large scale protests and critiques from civil society, measures were taken to boost the legitimacy of the process. |

De digitalisering van de samenleving heeft verschillende gevolgen voor de overheid en overheidsbeleid. Eén daarvan heeft betrekking op de manier waarop beleidsanalyse kan worden gebruikt. In deze bijdrage worden de mogelijkheden van meer adaptieve vormen van beleidsanalyse verkend, waarbij beleidsvoerders stap voor stap en op basis van informatie uit het beleidsproces proberen meer over de beleidsuitvoering te leren. Die vorm van beleidsanalyse, die op een aantal punten afwijkt van eerdere vormen, heeft gevolgen voor de organisatie van de overheid maar ook voor de wijze waarop het toezicht moet worden ingericht. Dat levert interessante vragen en spanningen op voor de ‘digitale’ overheid. |
