    This paper analyses various landmark criminal cases in the Netherlands that saw individual professionals being blamed for allegedly contributing to safety-critical events occurring in the past twenty years. These cases can be seen as symbolizing an increasingly risk-averse society whose expectations of human capacity for securing safety have reached unprecedented levels. In this view, punishing professionals who make dangerous mistakes serves to re-establish the illusion of being in control and to satisfy emotions. In practice, however, the prosecution of professional error appears to be somewhat out of touch with public sentiment, as responses to the cases discussed revealed little public support and a backlash among professionals. Moreover, safety science and practice claim that punishing individual error tends to undermine safety and overemphasizes the role of individual error compared to systemic failures. This begs the question of whether criminal liability should be imposed at the system level, as recently happened when local governments were sentenced following fatalities on dangerous road spots. Sentencing ‘system administrators’ may have advantages, but probably produces negative effects as well. Therefore, it would be ideal if administrators reduced the need for resorting to criminal law by proactively and generously taking responsibility for their organisation’s share in accidents.

Het stelsel van informatieveiligheid: een essay over hoe we moeten leren er klaar voor te zijn

Samenvatting

    Government cybersecurity requires action from many public and private actors. Both collective knowledge and collective priority are needed to ensure cybersecurity at a government level. This makes collective learning essential. There is a system of arrangements that includes all kinds of governmental organisations and private parties. How can learning be stimulated in this system? And what is the need for steering here? This article provides answers to these questions, based on the contributions in this special issue. We conclude that both central control and self-regulation are essential to cybersecurity, even if they are in conflict. We coin the term ‘complimentary self-regulation’. We also conclude that many arrangements have been developed or are under development, however, it is difficult to institutionalise the coherence between these initiatives. There is a long road ahead in terms of gaining a collective understanding. Cybersecurity and its organisation will probably not vanish from the administrative agenda any time soon.

    Politicians and scientists in the Netherlands often claim that only municipalities with over 100,000 inhabitants (so called ‘100,000+ municipalities’) have enough administrative power to be able to carry out their tasks in the future well. This is also the case for the responsibilities that recently have handed over to the Dutch municipalities as part of the three decentralizations. Against the background of this debate, the authors of this essay argue that the experiences of the four European microstates – Andorra, Liechtenstein, Monaco and San Marino –may offer an interesting frame of reference where it concerns the delivery of public services. These four countries have all the responsibilities and tasks of a sovereign state, but at the same time three of the four countries have a population of fewer than 40,000 inhabitants. Also, the fourth country is smaller than a 100,000+ municipality. Despite the small size of these states, their public services are of an exceptionally high level. Therefore this essay tries to answer two questions: How is this possible? What can we learn from the experiences of these microstates about the debate on scale and administrative power in the Netherlands?

    The Netherlands enjoys a long-standing reputation in the field of road safety. Following the ‘Sustainable Road Safety’ program of the 1990s, the infrastructural layout considerably reduces the risk of accidents while at the same time many measures are in place to improve road user behavior. In recent years, however, there have been several developments that may affect the success of the approach. In addition to an ageing population, urbanization, and the rise of new technologies, there is a combination of decentralization, policy integration, and budgetary restraints.
    This contribution presents the philosophy behind the sustainable road safety program and describes its key elements. It discusses policy and societal developments, and the continuing need to improve road safety, especially at a decentralized level. The article argues in favor of a continued systematic approach towards safer road traffic, also in periods of decentralization and limited budgets. It presents a concrete perspective of the role of policy analysis and policy evaluation to develop a proactive approach to road safety under the new conditions. In this, evidence-based interventions, an active use of safety performance indicators, and a focus on success are key elements.
