Aangescherpt bestuursgericht toezicht in de corporatiesector

Het wakend oog van de Autoriteit woningcorporaties onder de loep genomen

Tijdschrift Bestuurskunde, Aflevering 4 2018
Trefwoorden public accountability, regulation strategies, policy change, policy implementation, (social) housing sector
Auteurs Olga Verschuren Msc en Dr. Stefanie Beyens
Samenvatting

The Dutch social housing sector is still recovering from a series of incidents that harmed the sector’s reputation drastically. Part of the recovery plan is the installation of an independent Housing Authority, who focuses specifically upon the ‘governance’ of housing corporations. This article explores the implementation and development of the Authority’s regulation strategy. It finds that although the strategy sharpens the focus of housing corporations and limits risky circumstances and behavior, it also triggers adverse effects. The Authority should therefore adopt a broader outlook, that is more sensitive to (1) the complexity of the social housing task, and (2) the pathologies of multiple accountabilities being placed upon the corporation(sector).

SamenvattingAuteursinformatie

Using survey data from 1,300 welfare recipients in the Netherlands, this paper explores the effects of different enforcement styles in the field of social security law. Although most policy debates focus on punitive and persuasive enforcement, our findings suggest that both styles only play a limited role in explaining regulatory compliance. Our study also shows that the level of compliance among welfare recipients is related to their ‘motivational postures’ (Braithwaite 2003; 2009; 2011). While some of these ‘postures’ are shaped by elements of procedural justice, others are related to the perceived legitimacy of laws or to instrumental motives. Given these findings, we suggest that compliance with social security laws may not only depend on punitive or persuasive enforcement, but also on the degree in which regulatory enforcement is attuned to the individual characteristics of welfare recipients. Finally, these ideas are translated into several practical suggestions for the ‘smart enforcement’ of social security law.

De opkomst van voedselbeleid: voorbij de tekentafel

Tijdschrift Beleid en Maatschappij, Aflevering 4 2018
Trefwoorden Food policy, Food system, Agricultural policy, Policy integration, Policy instruments
Auteurs Dr. Jeroen Candel
SamenvattingAuteursinformatie

To address a range of interconnected food-related challenges, Dutch policymakers have invested in the development of integrated food policy in recent years. This article discusses this development in two parts. The first part contains a detailed description of the main events and lines of thinking that characterized the food policy process. From this description it becomes clear that food policy has been gradually developing towards a separate institutionalized policy domain. In the second part, this development is analysed from a policy integration perspective. This analysis shows that although considerable steps towards strengthened policy integration have been made, the Dutch ‘Food agenda’ does not yet proceed beyond symbolic levels. This particularly shows in the absence of concrete policy goals and in a policy instrument mix that has not been adjusted to strengthen consistency and effectiveness. In addition, the involvement of relevant ministries gradually decreased after the initial stages. The article concludes that the food policy process has arrived at a critical juncture: the next steps of the new government will prove decisive for whether food policy integration intentions will advance beyond the drawing board. Political and administrative leadership are identified as key conditions for such further steps to occur.

De dynamiek van slimme sturing voor de verduurzaming van handelsketens

Tijdschrift Bestuurskunde, Aflevering 2 2018
Trefwoorden smart governance, global value chains, Partnerships, voluntary sustainability standards
Auteurs Prof. dr. ir. Katrien Termeer, Dr. Hilde Toonen, Drs. Marcel Kok e.a.
Samenvatting

Traditional state-centered governance systems have failed to effectively tackle the transnational problem of the sustainability of global value chains (GVCs). To fill this ‘institutional void’, industry and NGOs established a series of global partnerships that designed standards and certification schemes for global commodities. This paper uses different theoretical lenses to address the question as to what extent these arrangements can be evaluated as smart, and for what and for whom they are smart? Despite their relative success, these partnerships face some serious challenges. Consequently, smart governance also requires adaptiveness and the prevention of path dependencies.

Waarderen of veroordelen?

De betekenis van kritische burgers die niet meepraten voor lokale participatieprocessen

Tijdschrift Bestuurswetenschappen, Aflevering 2 2018
Auteurs Drs. Christine Bleijenberg, Prof. dr. Noëlle Aarts en Dr. Reint Jan Renes
SamenvattingAuteursinformatie

To be able to realize the ambitions of citizen participation, diversity of participants is a crucial condition. At the same time excluding groups of citizens, amongst them critical citizens, is inextricably linked with citizen participation. In this article in the series ‘Local democratic audit’, the authors wonder what the exclusion of critical citizens means for the process and outcome of citizen participation. Through two empirical studies during a spatial intervention in different municipalities in the Netherlands, they investigated how people involved in a participation process spoke about critical citizens and their manifestations. The results show that the way these critical citizens are discussed either legitimizes exclusion or questions it critically. The legitimization of exclusion is detrimental to the support for spatial intervention. The problematization of exclusion results in a responsive approach to critical citizens, which is beneficial for both the course of the participation process and for the support for the spatial intervention.

Copingstrategieën bij onderwijsbestuur: over hoe onderwijsbestuurders complexe vraagstukken of dilemma’s waarderen en hanteren

Tijdschrift Beleid en Maatschappij, Aflevering 3 2017
Trefwoorden School boards, School board governance, Coping strategies, Proactive coping, Secondary education
Auteurs Hoogleraar Edith Hooge en Alumnus Nancy Plasmans
SamenvattingAuteursinformatie

This article is about how education administrators value complex issues or dilemmas they are confronted with in their governance practices, and which strategies they adopt to cope with them. Professional governance of school organisations was introduced gradually over the past fifteen years, and at the same time governance in education has gained in complexity and raises considerable risks, requiring more time, knowledge and expertise of education administrators. We draw on the theoretical perspective of coping to investigate the potential of education administrators to deal with the complexity, impediments and social and regulatory pressure in their daily practice. Our study consists of a comparative case study of six education administrators in secondary education. Their agency has been researched qualitatively with the help of the hierarchical model of coping strategies of Skinner and colleagues. The results show that the issues and dilemmas education administrators find most complex are about educational innovation and numbers of students enrolled. Education administrators value these issues or dilemmas hardly as threatening, and they adopt various proactive coping strategies to deal with them, such as information seeking or bargaining.

Beleid voor de irrationele mens

Hoe gedragswetenschap de bestuurskunde zou kunnen versterken

Tijdschrift Bestuurskunde, Aflevering 3 2016
Trefwoorden public administration, psychology, decisions, (ir)rationality
Auteurs Dr. Marijke van Putten, Prof. dr. Wilco van Dijk en Prof. dr. Eric van Dijk
Samenvatting

Policy is often based on the assumption that people are rational decision makers. Rational decision makers search all relevant information before they make a decision. They list the pros and cons of relevant options and make a well thought choice that best fits their fixed preferences. However, research from amongst others psychology and behavioral economics shows that people decide differently and that they are irrational, emotional decision makers instead. Policy therefore fits people’s decision making strategies worse than expected. It is important for policy makers to gain insight into situational influences on decisions and the influence of the so-called choice architecture on decisions. In this article we discuss research that tested when policy was more efficient, based on behavioral insights and the view of man as an irrational, emotional being.

Proactieve ‘coping’ door publieke professionals

Tijdschrift Beleid en Maatschappij, Aflevering 4 2015
Trefwoorden Public professionals, Teachers, performance pressures, proactive coping, professional capability
Auteurs Prof. dr. Mirko Noordegraaf, Nina van Loon MSc, Madelon Heerema MSc e.a.
SamenvattingAuteursinformatie

Professional services such as educational services, are increasingly managed and optimized in order to improve performances. Performances of students, teachers and school (boards) are measured and evaluated. Increasingly, rules and systems focus on outputs and control. Consequently, the ‘freedom’ of professionals such as teachers is reduced, or is perceived and felt to be reduced. There have been growing debates on the problematic effects of performance pressures. Often, public professionals are seen as ‘defenseless victims’ of systems and pressures – they are ‘professionals under pressure’. In this paper, we introduce a more positive way of understanding professionals and professional action in changing contexts. We see professionals such as teachers as ‘active agents’ who can develop and regain control over their own situation. Professionals can deliver quality, in spite of bureaucratic burdens and managerial intrusions. We call this ability professional capability: ‘the ability to proactively deal with work-related expectations, tasks and burdens in dynamic stakeholder environments’. This paper combines research on public administration, organizational sociology and occupational psychology, to generate a more productive understanding of proactive coping of professionals in public domains. We define and operationalize professional capacity, we explore sources and effects, and we develop hypotheses for further research.

Pas op! Over beheerst risico’s beheersen in het governancetijdperk

Tijdschrift Bestuurskunde, Aflevering 3 2015
Trefwoorden risk management, governance, inspection, organization, hybridization
Auteurs Dr. Mark de Bruijne, Dr. Bauke Steenhuisen en Dr. Haiko van der Voort
SamenvattingAuteursinformatie

Risks taken by some organizations may have considerable impact on society. In this contribution the assessment and management of risk are perceived to take place in a multi-actor setting. Within an organization operators, risk managers, and top managers interact about risk assessments and risk mitigation strategies. Public regulators and inspectorates increasingly focus on risk management systems instead of the operational activities or organizational outputs. Are organizations systematically assessing their risks? This contribution identifies two contrasting perspectives on risk assessment and risk mitigation in literature: risk management and risk governance. An empirical study in three sectors reveals evidence of both perspectives in practice. Companies adopt hybrid approaches, which are essential for the quality of risk assessment and mitigation. Indeed, adopting just one perspective seems dangerous. We conclude that public regulators and inspectorates might provide incentives to focus on just one perspective and suggest two heuristics for public inspectorates that respect hybrid approaches of risk assessment and mitigation.

In dienst van beleid of in dienst van de democratie?

Een studie naar de waarden achter overheidscommunicatie

Tijdschrift Bestuurswetenschappen, Aflevering 1 2014
Auteurs Harrie van Rooij en Noelle Aarts
SamenvattingAuteursinformatie

More than twelve years after the appearance of the report of the Dutch Committee on the Future of Government Communication (‘Commissie Toekomst Overheidscommunicatie’) communication as the responsibility of the government is an important issue of debate and a discipline that is alive and kicking. We may even conclude that communication – in the terminology of this report – has conquered a place in the heart of policy. A lot is still unclear about the communicative function of government. On the normative question ‘why should the government communicate’ diverging answers are possible. However, the question is hardly discussed in practice and in science. For this reason the positioning of government communication as a separate discipline is also unclear. Reflection on the elementary values behind the discipline can reveal themes that have been invisible so far. The article investigates which values and motives are attached in theory and in practice to communication as a governmental function. For this reason a content analysis has been carried out of a number of volumes of five Dutch magazines (practical and scientific). The authors conclude that for professionals communication mainly is an instrument to support policy goals. The possibility to make a purposeful contribution with government communication to democratic values hardly is brought about, not so much in Communication Science as in Public Administration.

Co-regulering: niet doen! Of toch?

Een essay over de beoordeling van co-regulering vanuit twee interpretaties van governance

Tijdschrift Bestuurskunde, Aflevering 3 2013
Trefwoorden co-regulation, inspection, governance, assessment
Auteurs Haiko van der Voort
SamenvattingAuteursinformatie

Public regulators and inspectorates are increasingly involved in self-regulatory initiatives. This contribution is about co-regulation, which are co-ordination efforts among public regulators and self-regulating institutions. In co-regulation arrangements typical regulation and oversight activities, such as standard setting, information gathering and sanctioning become subjects of co-ordination between public and private actors. Co-regulation arrangements are typically network efforts. At the same time ‘regulation’ has a hierarchical connotation. This paradox shows in interpretations of ‘governance’ and ‘the move from government to governance’, the latter being a popular phrase qualifying a change of the government’s role in society. Main question in this paper is what the changing role of government in society means for the assessment of co-regulation. Based on literature two implicit, but opposing interpretations of ‘governance’ and the change are described. This implicitness may cause unsound assessments of co-regulation, either too tough or too lenient. In this contribution the normative implications of both interpretations are made explicit for co-regulation. The argument is illustrated by the case of co-regulation in the Dutch coach travel industry.

SamenvattingAuteursinformatie

The lessons learned from the financial crisis are not necessarily limited to the financial sector. Both the financial sector and the public sector have to deal with perverse effects. The effects can be related to a reduction of complexity and plurality through introducing (oversimplified and one dimensional) models and financial incentives. However, in doing this, complexity and plurality are often lost: the neglect of multiple interests, goal replacement and too much focus on short term results. As a consequence perverse effects arise.
Public sectors and organizations face internal and external pressure to act as they do. At the level of organizations or groups this may involve groupthink; at institutional level uniformity is promoted by the dynamics of isomorphism. This article is a critique on simplification and a plea for the (re)introduction of plurality. More specifically, we stress the importance of individual moral responsibility as a resource for and a way to preserve plurality. Not because that is the only option, but because it is an option that we believe deserves more attention. Other options such as changing regulations and changing the structure of supervision are already broadly discussed. We want to draw attention to the individual as parts of multiple organizations and systems. Individuals are therefore a natural carrier of multiplicity and plurality. Taking moral responsibility serious is not an easy task, but a meaningful step towards awareness of perverse effects due to reduction of complexity and plurality.

In een groen, groen polderland

De mix tussen corporatisme en lobbyisme in het Nederlandse milieu-beleid

Tijdschrift Beleid en Maatschappij, Aflevering 4 2005
Auteurs Dave Huitema
SamenvattingAuteursinformatie

This article discusses the degree to which Dutch environmental policy exhibits a shift from corporatism to lobbyism. Based on a general analysis of environmental policy making in the Netherlands and two specific cases of environmental decision making, the author draws the conclusion that such a shift has not happened. At the level of policymaking it is rather the opposite: in the 1980s the Ministry of the Environment introduced a certain level of corporatism. This was possible because of a clear framework of environmental policy goals shaped by the National Institute for Public Health and Environment (RIVM), because the environmental movement began to see the Ministry as an ally and because business interests preferred self-regulation (one element of corporatism) to government regulations. In two concrete case of environmental decision-making that are discussed here, environmental goals are being discussed once more. During such discussion, it appears that Dutch ministries have close connection to 'their' target groups. For the coming years, environmental policy will 'Europeanize' further and Dutch economic interest groups, although being remarkably late in responding to this shift, will start to influence the Brussels policymaking game instead of the Dutch implementation game.
