    In 2020 and 2021 there were many examples of manifestations and disturbances in the Netherlands in which social media played an important role. On a number of occasions, fights were fought in the physical world that originated in the online world, for example from the drill rap scene. The increase in victims of digital crime also became apparent. During this period, a number of Dutch mayors came to the media with a clear message that they wanted more options/powers to respond to this. Previous research has shown that mayors cannot use powers online, but they can maintain order in other ways. Students from NHL Stenden University of Applied Sciences (in Leeuwarden) therefore conducted an exploratory study in the autumn of 2020, in collaboration with the Cybersafety research group, into the practical possibilities and (political) views with regard to administrative law options: a digital restraining order. In this contribution, attention is paid to the question of whether a digital version of the physical restraining order as a formal authority of mayors can contribute to the prevention of disturbances of public order that have their source in the online world.

    Governments around the world responded at roughly the same time but in several different ways to the emerging threat of COVID-19 in early 2020. This article sets out the nature of the different strategies that emerged over the course of the pandemic, focussing on the policy tools deployed. Some of these efforts were successful in containing the coronavirus while others were not, in some cases due to poor initial choices and in others due to poor implementation of the chosen strategy. Although the initial understanding each government had of the nature of the disease was the same, different state capacities and different levels of preparedness and effective leadership can be seen to have resulted over time in the emergence of six distinct approaches to the pandemic which, once deployed, proved difficult, although not impossible, to change as the pandemic unfolded.

    Despite the highest ranks on pandemic preparedness assessments European welfare states encounter great difficulty in responding effectively to the COVID-19 outbreak. In this article we compare the governance of COVID-19 response in 48 Eurasian countries and a selection of European and SARS (2003) exposed Asian countries during the first wave of the COVID-19 outbreak until 1 June 2020, using data from the COVID-19 Health System Response Monitor and the Oxford COVID-19 Government Response Tracker, recent scientific literature and policy documents.
    Pandemic preparedness during the first wave of COVID-19 evolved from specialist infectious disease control to a broad governance of population mitigation, which in at least half of Eurasian countries lacked appropriate authority and capacity. In the directly operational response in Asian countries, preparedness encompasses a whole of government approach, an engaged and active community and private actors. Preparedness requires and reflects both vertical and horizontal coordination as well as policies that fit with the political economy of a country and region.

    Sometimes dreams become reality, but there are also many examples in which manic ideas for image-defining projects turn into fiascos. How do you find the right balance in the planning and decision-making of image-defining projects between taming manic mechanisms that cause these projects to fail and unleashing manic mechanisms that are necessary to make these projects happen? This article attempts to answer this question by exploring how the taming of mania (through welfare-economic analysis) and the unleashing of vision and ambition (through imagination) can be combined in a better way. We call this a search for an ‘imaginative utilitarianism’ and draw up three preconditions under which this approach can work: (1) more attention to incremental and less grotesque projects, (2) a different appreciation and historiography that places individuals less centrally and also appreciates what has not been built, and (3) a stronger interweaving between the design process and a welfare-economic approach.

    Fiscal consolidation confronts federal states with a collective action problem, especially in federations with a tightly coupled fiscal regime such as Belgium. However, the Belgian federation has successfully solved this collective action problem even though it lacks the political institutions that the literature on dynamic federalism has identified as the main mechanisms through which federal states achieve cooperation across levels of government. This article argues that the regionalization of the party system, on the one hand, and the rationalization of the deficit problem by the High Council of Finance, on the other, are crucial to understand how Belgium was able to solve the collective action problem despite its tightly coupled fiscal regime and particularly high levels of deficits and debts. The article thus emphasizes the importance of compromise and consensus in reducing deficits and debts in federal states.

    This article takes up Lijphart’s claim that consensus democracy is a ‘kinder, gentler’ form of democracy than majoritarian democracy. We zoom in on contemporary welfare state change, particularly the shift towards social investment, and argue that the kinder, gentler hypothesis remains relevant. Consensus democracies stand out in regard to the extent to which their political institutions help to overcome the politically delicate intricacies of governing for the long term. We theorize the features that can help to solve the problem of temporal commitment in democracy through processual mechanisms and illustrate these with short case studies of the contrasting welfare state reform experiences in the Netherlands and Belgium.

De kritiek op rct’s is echter in de loop van de jaren alleen maar groter geworden. Bovendien blijkt uit een recente meta-evaluatie dat de non-experimentele onderzoeken niet tot andere uitkomsten leidden dan de rct’s. Al met al wordt te veel geloof gehecht aan de evidence-based benadering in het algemeen en rct’s in het bijzonder. Vandaar de vraag: wordt het misschien tijd voor een Maryland Scientific Methods Scale 2.0?

De ongekende effecten van deregulering: een experiment in Hollands Kroon

    What happens in the case of massive deregulation in the local public domain? Despite the widespread call for ‘less regulation’, the effects of large-scale deregulation have received surprisingly little academic attention. In this article, we present the results of a longitudinal study on the effects of deregulation in the Dutch municipality of Hollands Kroon. The municipality abolished a vast number of regulations on public order offences in a radical two-year policy experiment, encouraging citizens to exercise more social control. In contrast, criticasters expected that the experiment would lead to more public offenses and conflict. Based on our data collected over three survey rounds; focus groups with citizens, politicians and civil servants; and several secondary data sources, we conclude that there was little effect: neither an increase in public order offences, nor an increase in social control. Our research shows that, in the short term, deregulation did not significantly affect the behavior of citizens.

    Traditional state-centered governance systems have failed to effectively tackle the transnational problem of the sustainability of global value chains (GVCs). To fill this ‘institutional void’, industry and NGOs established a series of global partnerships that designed standards and certification schemes for global commodities. This paper uses different theoretical lenses to address the question as to what extent these arrangements can be evaluated as smart, and for what and for whom they are smart? Despite their relative success, these partnerships face some serious challenges. Consequently, smart governance also requires adaptiveness and the prevention of path dependencies.

    Since the start of the 21st century, most nations have followed the lead of the World Health Organization and developed specific policies to tackle the ‘global obesity epidemic’. The medical reasoning is that non-contagious diseases are the most important causes of mortality and morbidity, especially in prosperous nations. As these diseases are conceptualized as ‘caused’ by ‘unhealthy lifestyle choices’, there is dire need for preventive lifestyle policies that help people make ‘the healthy choice’. Seen from this perspective the distribution of responsibilities between governments and their citizens is made in accordance to the ‘intervention ladder’, which has been developed from a stewardship model.
    Regarding the ‘obesity epidemic’, this contribution tests the basic medical claims behind this science policy complex. We find that the knowledge base for these claims is highly uncertain and that interventions lack efficacy. Furthermore, research points to increased levels of stigmatization of ‘fat people’, leading more discrimination. All this changes the status of the policies from preventive (i.e. proportionate) to precautionary (i.e. disproportionate). Further analysis of the preventive medical and policy paradigms shows both are by default biased towards precaution. Combined with the notion that citizens of democratic societies are entitled to trustworthy and transparent information, this contribution concludes that a reorientation of both paradigms is called for.

    The crowd increasingly plays a key role in facilitating innovations in a variety of sectors, spurred on by IT-developments and the concomitant increase in connectivity. Initiatives in this direction, captured under the umbrella-term ‘crowd-based innovations’, offer novel opportunities in socio-technical systems by increasing the access, reach and speed of services. At the same time, they signify important challenges because these innovations occur in a context of traditional, well-established institutional and governance structures and practices. This dynamic is captured in the idea of the ‘institutional void’: the tension between traditional structures and (radically) new initiatives. Existing rules, standards and practices are challenged, which raises questions about the safeguarding of public values such as quality, legitimacy, efficiency and governance of crowd-based innovations. This article argues that understanding these tensions requires supplementing empirical research with an explicitly normative dimension to reach thorough and balanced conclusions to facilitate innovation while protecting the valuable elements in existing rules and regulations. Illustrated by a number of short examples, we propose a multidisciplinary research agenda towards formulating appropriate governance structures.

    For aldermen in Dutch municipalities, ‘integrity’ increasingly seems to be an important factor causing their downfall. A lot of aldermen have resigned in the recent years because of ‘integrity’ and invariably local and national media were actively involved in this process. This article deals with the question of the role of the media in integrity affairs involving aldermen that have to resign. To answer this question, the authors analysed ten affairs that occurred in 2014 in which an alderman had to resigned (forced or voluntarily) because of integrity issues. The analysis shows that local media, regardless of how small they may be and how limited their means, often report extensively about integrity issues. In some cases, local media even act as accountability forums that call these aldermen to account. In other cases, the coverage in local media leads to further questions and calls for political accountability in the municipal council. Sometimes the media ‘merely’ report on the debates between the municipal council and the municipal board, but by doing so magnify the impact of an affair in the local community. In this way, the media fulfil their democratic role as watchdogs of local democracy, a role in which they bark loudly, often persistently and sometimes venomously about (alleged) integrity affairs.

    Science and practice are largely agreed on the importance of interorganizational cooperation in the approach of tackling complex societal problems. Organization transcending innovation through this type of cooperation however appears to be complicated. Based on an analysis of the literature about partnerships, the authors distinguish three challenges: coping with the tension between old and new accountability structures, building good working relationships and developing capabilities for problem-oriented working. Starting from these insights they designed action research into problem-oriented partnerships in the safety domain (safety chain). Their main question was: what is the most important obstacle for innovation through problem-oriented interorganizational cooperation? Over a period of nine months, they watched eight teams of professionals from different organizations. Their task was to develop and implement innovative approaches to tackle persistent organized crime. Although all three challenges identified in the literature indeed played a prominent role, problem diagnosis and problem definition appeared to be the main obstacle for the teams. In this article the authors describe the action research and explore, on the basis of the results and the literature, how partnerships could cope in practice with the challenge of problem definition and problem analysis. They conclude the article with suggestions for the design of a follow-up round of the action research.

    In the safety domain important developments are currently taking place concerning the way in which administrative and tactical operations are dealt with in crises. It is characteristic for the approach that cooperation in chains and networks is increasingly needed to arrive at a suitable approach. In this essay, the authors analyse two subdomains in two concrete cases on how cooperation between several parties takes shape and functions. For that purpose, they differentiate between acute and non-acute crises. In the subdomain ‘acute crises’, they have chosen the case of the Dutch town Moerdijk (the fire at the Chemie-Pack company in 2011). In the subdomain of non-acute crises, they focus on community safety partnerships (‘Veiligheidshuizen’), especially on the community safety partnership in the Dutch province of Friesland (‘Veiligheidshuis Friesland’). In both subdomains the establishment of a good basic cooperation and leadership structure appears to be of prime importance. From there it is necessary to respond in a flexible manner (to be able to execute custom-made work). Within that framework, the capacity may develop to arrange a well-structured and effective cooperation at the operational level (ad hoc in acute crises), to monitor progress properly and to carry out targeted interventions if the developments in the situation ask for these interventions. A good knowledge of each other’s frame of reference is necessary to make this work, so that a maximum level of integration in the approach is achieved.

    Een lerende overheid heeft behoefte aan beleidsevaluaties die niet alleen van betekenis zijn voor het onderwerp waarop deze primair gericht zijn, maar ook bijdragen aan bredere, systematische opbouw van kennis en ervaring. Het interdepartementaal verbinden van expertise verruimt daarbij het zicht op factoren die het leren bevorderen of belemmeren.
    Een centrale vraag is of de door het beleid beoogde publieke belangen inderdaad bevorderd worden. Beleidsevaluatie moet dan niet alleen gericht zijn op effectiviteit en doelmatigheid ten aanzien van relatief gemakkelijk meetbare indicatoren, maar ook op lastig te kwantificeren essentiële waarden zoals subjectief welzijn, rechtvaardigheid en maatschappelijke aanvaardbaarheid. Het verdient aanbeveling kostbare evaluatie-energie te concentreren op belangrijke kwesties waarover vooraf discussie of onzekerheid bestaat.
    Uit een oogpunt van doelmatige beleidsvoorbereiding, en omdat de uitwerking van wetgeving en beleid ex post niet altijd eenvoudig is vast te stellen, is veel aandacht nodig voor ex ante evaluatie. Van onderzoek naar werkingsmechanismen van beleidsmaatregelen wordt in dit verband terecht veel verwacht.
    Er is sprake van een paradoxaal spanningsveld tussen verwetenschappelijking en politisering van beleid. Daarom is stevig verankerde, onafhankelijke en onpartijdige beleidsevaluatie onmisbaar. Hoge methodologische kwaliteit biedt extra houvast om deze functie geloofwaardig te kunnen vervullen.
    In het streven naar systematische opbouw van kennis en ervaring naast dossier-specifieke doelbereiking kan het helpen als evaluaties zowel een specifiek als een breder geldend algemeen deel bevatten. Belangrijk is ook te sturen op een evenwichtige evaluatieportfolio per beleidsterrein, met aandacht voor ex ante en ex post methoden, uiteenlopende waarden, en verschillende informatiebronnen. Naast best practices moet daarbij ook minder geslaagd beleid in beeld worden gebracht. Voor de bruikbaarheid van evaluaties voor de praktijk is goede vertegenwoordiging van het bottom-up perspectief noodzakelijk.
    Evaluatie van beleid vereist gedegen inbedding binnen de nationale kennisinfrastructuur, effectieve samenwerking met kennisinstellingen en het up-to-date houden van het evalueren zelf. Dat is cruciaal voor het evaluatievermogen van de lerende overheid.

    In de praktijk is het niet altijd haalbaar om effectonderzoek uit te voeren met behulp van een experimentele trial. Het N=1 design is een alternatieve opzet voor effectonderzoek bij interventies met kleine aantallen. Centraal bij de N=1 aanpak staat dat bij een kleine groep deelnemers via verschillende observanten op meerdere tijdstippen informatie wordt verzameld over de ontwikkeling van deelnemers. Daarbij kan zowel gebruik worden gemaakt van kwantitatieve als kwalitatieve onderzoeksmethoden. Dit artikel beschrijft de toepassing van het N=1 design in een onderzoek naar de doeltreffendheid van de justitiële gedragsinterventie Multidimensional Treatment Foster Care (MTFC). Deze interventie is ontwikkeld voor jeugdigen tussen de 12 en 18 jaar met ernstig antisociaal gedrag. In het onderzoek is de ontwikkeling van acht MTFC-deelnemers in kaart gebracht via vragenlijstonderzoek en interviews. Naast de toepassingsmogelijkheden worden in dit artikel tevens de beperkingen en risico’s van het N=1 design beschreven.
