Sturing van warmtenetten: naar een typologie van governance-structuren van warmte-infrastructuren

Tijdschrift Bestuurswetenschappen, Aflevering 3 2016
Auteurs Dr. Maurits Sanders, Mr. Anne Veerle Brunnekreef en Prof. mr. dr. Michiel Heldeweg
SamenvattingAuteursinformatie

A promising option in energy transition is a more efficient use of heat by linking local heating projects to a regional infrastructure. Although this is technologically feasible and the local officials are often benevolent, such projects only scantily get off the ground. The main challenge appears to be the aspect of the appropriate type of governance for the design and use of regional heat networks. The authors of this article developed a governance-typology for heat networks. The aim of the typology is to help unravel the complexity in the planning of heat infrastructures, taking due account of some legal principles. This typology also enables to categorize heating projects. In this way it is possible to provide some insight in the influence of the stakeholders’ preferences on the governance of heat infrastructures. Barriers and opportunities can be reduced that may hinder or promote the use of waste heat. Local officials may use the information for preventing or breaking through deadlocks in the planning of heat infrastructures.

This special issue contains five articles based on empirical research into energy transition at the local level. The focus is on the role of local authorities in the energy transition and on partnerships between local authorities (municipalities, provinces, regions) and local communities in the area of sustainable development. The three guest editors have also written an introduction and conclusion for this special issue.

Publiek-Private Samenwerking

Een reparatiestrategie voor falende ordeningsvormen

Tijdschrift Bestuurskunde, Aflevering 3 2014
Trefwoorden Public-private partnerships, governance arrangements, public values
Auteurs Dr. Maurits Sanders
SamenvattingAuteursinformatie

Government employs Public-Private Partnerships as a remedial strategy directed at compensating for failures that typically occur in pure market arrangements, networks or pure hierarchical government settings. It is then possible to engage in Public-Private Partnerships corresponding with the three basic forms of social organization: market, network and government. The distinction between: (1) market-PPP, (2) network-PPP and (3) public authority-PPP is elaborated.

In policy practice sometimes organizational arrangements appear that at first glance manifest itself as cooperative relations between private organizations, but about which on second thoughts the question can be asked if after all there is an active input from the side of the government. This is for instance the case in the construction of biogas infrastructures. In this article the authors discuss if we can talk about PPC after all. In the debate on governance this question is important because in the design of PPC the public interest involved must be sufficiently guaranteed in terms of control and accountability. On the basis of a confrontation between the results of a literature review and an empirical study of the case of a Green Gas pipeline in North-East Friesland (‘Biogasleiding Noordoost Fryslân’) in the Netherlands, the authors conclude that public steering in practice can take a form in disguise. Using ‘intermediate’ civil law legal persons, governmental influence indeed can be and is exercised during the cooperation. Especially law poses specific demands on control and accountability to take care of public interests, like the promotion of the use of renewable energy. Likewise in this kind of projects, especially in comparison with pure private-private cooperation, the public and if possible even the public law regulation must be safeguarded, for instance by transparency of form and content of steering. Of course this has to be done with preservation of the cooperative nature that is typical of PPC.

Groengasprojecten: energietransitie in ruraal Nederland?

Tijdschrift Beleid en Maatschappij, Aflevering 2 2013
Trefwoorden green gas, Biogas, renewable energy, stakeholder analysis, climate policy
Auteurs Drs. Maurits Sanders en Dr. Thomas Hoppe
SamenvattingAuteursinformatie

‘Green gas’ is a sustainable alternative to natural gas. It is produced by converting biomass into biogas, which can consequently be upgraded to natural gas standards. Expectations about green gas are high. According to the long term vision of Netbeheer Nederland, the representative association of gas grid operators, green gas will entail 50 percent of the domestic gas mixture by 2050. In line with this vision national government has adopted a green gas innovation support program. Production of green gas takes place in rural areas with abundant supply of organic production resources, especially manure. It is in demonstration projects that green gas niche development is to be proven. In this paper the central question is how green gas demonstration projects manifest at the local level. By conducting a stakeholder analysis, we take a ‘bottom-up’ research approach, which helps us to identify organizational and institutional barriers key local stakeholders have in relation to green gas demonstration projects. We judge this necessary to further understanding in green gas niche development. The results of the analysis are used to advice policymakers about design and use of policy instruments which can help to solve these barriers.

Botsende publieke waarden bij publiek-private samenwerking

Dimensies en dilemma's van juridisch-bestuurskundige legitimiteit, in het bijzonder bij openbaar gezag

Tijdschrift Bestuurskunde, Aflevering 2 2011
Trefwoorden Good governance, public-private partnerships, legitimacy
Auteurs Michiel Heldeweg en Maurits Sanders
SamenvattingAuteursinformatie

Public Private Partnerships (PPP), especially those geared to exercise public legal powers (‘Authoritative PPP’), are suggestive of tensions between private party involvement and public legitimacy. Hence, public legitimacy is analyzed primarily on the basis of work done by David Beetham, and complemented with Public Law legitimacy considerations concerning the exercise of legal powers and law on public organizations. The findings project that there is room to convincingly frame legitimate PPP involving public authority, but that the scope is restricted both in terms of legal constraints and of political sensitivity. As a result of this, truly wicked policy projects, which in theory stand to gain most by PPP, in practice seem to be considered less suited for Authoritative PPP (and probably more for Network PPP).
